There are many different types of personal injury cases. In today’s world, many cases are caused by motor vehicle accidents—whether by “ordinary” cars, tractor-trailers, commercial vehicles, motorcycles, or a pedestrian or cyclist hit by a car—but they can also include dog bites, slip and falls, products liability, and many other types of incidents. Personal injury law also includes cases where someone has died because of someone else’s negligence (known as “wrongful death”).
-
First, check yourself for injuries and, if you can safely do, check on others in your vehicle or other vehicles. Then, move yourself to safety and call 911 to request emergency services. If you can, take pictures of the scene, the vehicles involved, and any visible injuries. If you’ve been injured, seek medical attention immediately.
-
Call for help if others are nearby and call 911. If you’re able, document the scene and take pictures of the area where you fell. You should also notify the business or property owner of the incident immediately.

In Virginia, a victim of negligence may be able to recover money for past and future medical expenses, pain and suffering, lost wages, lost earning capacity, and other damages. These damages are awarded to the victim through a settlement or a verdict at trial in the form of money. A personal injury attorney represents victims of negligence to try and recover the maximum amount of damages and compensation possible under the particular circumstances of a victim’s case. But a personal injury attorney also relieves clients of stress by keeping the insurance company away and letting clients focus exclusively on treating their injuries and trying to get their lives back on track.

Virginia follows a rule called “contributory negligence,” which is a strict law that fully prevents you from recovering any damages if you’re partially at fault for causing the incident or your own injuries. However, determining whether you’re partially at fault is a legal question and may not have a clear answer, so you should discuss your case with an attorney. Puglielli Injury Law will review liability with you during a consultation.
-
If you were working when you were injured by someone else’s negligence, you may have a personal injury claim. However, determining whether or not you have a claim under those circumstances can be complex, and you may also have a claim under the Virginia Workers’ Compensation Act, so you should consult with a personal injury or workers’ compensation attorney as soon as possible.
-
Puglielli Injury Law is transparent with its fees and works on a contingency fee basis that’s one-third (33.33%) of the overall settlement or judgment. This means that you don’t pay anything up front, and Puglielli Injury Law only gets paid if you recover money in your case. If Puglielli Injury Law is unable to get you a recovery, then you won’t owe the firm a fee for its services.
-
In Virginia, a lawsuit for personal injuries must be filed within two years after the “cause of action accrues.” Determination of that two-year period may not be as clear as it seems, so you should consult with a personal injury attorney as soon as possible to ensure a personal injury claim is timely filed. Failure to file a lawsuit on time may cause you to permanently lose your right to a settlement and compensation.
-
Many personal injury cases settle without the need to file a lawsuit, and even when a lawsuit is filed, many cases settle before going to trial. However, a lawsuit and trial may be necessary depending on the facts of your case or if a fair settlement can’t be reached. Puglielli Injury Law is experienced with taking cases to trial and does not shy away from litigation.
-
The length of your personal injury case can vary. Some cases can resolve in several months, while others can take longer, such as several years. It’s often difficult to determine how long a case will take at the beginning but can be calculated more accurately as the case moves ahead. If you’re represented by Puglielli Injury Law, you’ll be kept informed about the status of your case and how close it is to a resolution.
